Scottsdale Considers Strengthening Local Laws to Address Noise, Nuisance Parties, and Short-Term Rentals

The Scottsdale City Council is set to deliberate on amendments to city code provisions aimed at enhancing accountability for disruptive neighborhood gatherings frequently seen at short-term rental properties. Mayor David D. Ortega emphasized the need for these changes, stating, “Scottsdale neighborhoods have consistently expressed frustration with short-term rental properties that market themselves as party pads and host loud, late-night gatherings.”

The proposed ordinance changes include designating promoters of nuisance parties at residential properties as responsible parties, granting Scottsdale police the authority to remove non-residents from a property following a declared nuisance party, and prohibiting minors from renting short-term rental properties. These adjustments have garnered substantial support from the community, with nearly 2,200 residents voicing their approval through the city's online engagement platform.

The surge in nuisance party incidents, particularly at short-term rental properties, has prompted these regulatory actions. Mayor Ortega acknowledged the challenges posed by short-term rentals, stating, “No question, short-term rentals are both a nuisance and a hazard. We believe these ordinance changes will strengthen our ability to hold party promoters accountable.”

Despite the evident issues associated with short-term rentals, the city faces limitations in implementing more stringent regulations. The Arizona State Legislature's A.R.S. §9-500.39 restricts local jurisdictions like Scottsdale from imposing bans or stricter ordinances on short-term rentals. Mayor Ortega highlighted efforts made by the city to advocate for regulatory reforms at the state level, emphasizing the need for legislative changes to address the challenges posed by problem properties.

Residents grappling with disruptive properties are encouraged to access resources such as the "Good Neighbor Guide for Scottsdale residents and neighborhoods" and seek further information on short-term rentals at ScottsdaleAZ.gov. The city remains committed to leveraging all available tools within the confines of state law to address the issues surrounding short-term rentals and nuisance parties.
