The City of Scottsdale and its Police Department are seeking public comment for Scottsdale Revised Code Sections 17-108 and 17-129 and adding Scottsdale Revised Code Section 17-130 relating to towing from public property by the City. Read the Scottsdale Revised Code Section 17-108. Scottsdale Revised Code Section 17-129.
The proposed changes include the following:
- Specifically authorizes police aides in addition to police officers to tow vehicles from public property when appropriate.
- Authorizes towing of vehicles by police officers and police aides when appropriate for the following parking violations on public property:
- Where prohibited by official signs or where the curb is painted red.
- Within a designated public transit stop.
- On a sidewalk, or in that area between the curb and sidewalk.
- On those roadways without curbs in a manner so as to force a pedestrian to walk in the traveled portion of the roadway.
- In front of a public or private driveway or the entrance to an alley.
- Within an intersection.
- Within fifteen (15) feet of a fire hydrant.
- On or in a pedestrian crosswalk.
- Within twenty (20) feet of the driveway entrance to any fire station and on the side of the street opposite the entrance to any fire station within seventy-five (75) feet of the entrance when properly posted.
- Alongside or opposite any street excavation or obstructions when stopping, standing or parking would impede traffic.
- Upon any bridge or other elevated structure upon a street or within a street tunnel.
- In such proximity to fire department inlet connections or fire-protection system control valves that it would prevent such equipment from being readily seen and easily accessed by fire department personnel, vehicles or equipment.
- Within a designated bicycle or turn lane.
- Marked parking spaces provided for a physically disabled person.
- Authorizes City airport personnel to tow vehicles within the confines of the Scottsdale Airport that are parked or standing in violation of official signs, where the curb is painted red, parked without authorization in a reserved parking space or obstructing airport operations. Any tows conducted by airport personnel must be reported to the Police Department.
- Creates a hearing process for any tows done for the above violations.
- Makes other conforming and technical changes.
- The ordinance does not limit the power and authority of the City and its Police department, its officers, police aides or other duly authorized agents to take any other action when they may otherwise be required or permitted to do so under the laws of the State or the City.
