The Scottsdale City Attorney's Office has announced that it has closed the investigation into the Gilbert Ortega incident. After a careful review of the evidence, including cell phone and surveillance videos, police reports, and translations of the suspect's statements, the City Attorney's Office has determined that there is no reasonable likelihood of conviction in this matter.

In a statement, the City Attorney's Office explained that while Gilbert Ortega's behavior was disrespectful and crass, it did not constitute the criminal offense of disorderly conduct. The victims in the incident were performing cultural dances in the Old Town Scottsdale area, and the suspect began mocking them and pantomiming their dance. However, this behavior, though offensive, did not meet the threshold for criminal charges.

The video footage also showed an ensuing verbal argument between the suspect and the victims, during which both parties exchanged insults. The suspect used a racial epithet towards one of the victims, but after a review by the FBI and a native Navajo speaker, it was determined that the suspect's statements did not constitute threats and did not support a charge of threatening and intimidating.

Furthermore, there was no evidence to suggest that the suspect knowingly or intentionally assaulted anyone, despite the victim's request for an assault charge to be considered.

While the City Attorney's Office concluded that the incident did not rise to the point of criminality, they acknowledged that the suspect's behavior was vulgar and upsetting to all those involved, and it tarnished the reputation of the Scottsdale community.

It is important to note that the City Council had no influence over the prosecutorial decision. Neither the Mayor nor any City Council member attempted to involve themselves in the investigation or decision-making process.

In response to the incident, the City of Scottsdale issued a statement expressing its rejection of racism and hate speech. They described the conduct recorded on video as a "nauseating example of bigotry" and emphasized their commitment to promoting cultural awareness, understanding, and unity in the community.

The Scottsdale Human Relations Commission and other community partners will continue to work towards creating an inclusive and respectful environment for all residents.

The investigation into the Gilbert Ortega incident has now been concluded, but it serves as a reminder of the importance of addressing and combating bigotry in society. Scottsdale remains dedicated to fostering a community that welcomes and respects all individuals, regardless of their background or culture.
