Scottsdale City Council files notice challenging Arizona law on Axon development

The Scottsdale City Council has decided to file a notice of claim and notice of unconstitutionality with the State of Arizona regarding Senate Bill 1543. The council’s decision, made during a special meeting on September 12, is intended to formally notify the state about concerns over the constitutionality of the recently passed legislation.

A notice of claim is an initial step that can lead to litigation but does not itself constitute legal action. In this case, the council voted 4-3 against authorizing litigation at this time. Future litigation could still be considered by a separate council vote.

Senate Bill 1543 was passed by the Arizona Legislature and signed into law in April. The bill allows Axon, along with other organizations classified as “international headquarters campuses,” to develop housing such as multifamily apartments or condominiums, hotels, and other related uses next to their already approved corporate headquarters facilities.

The new law may override a planned referendum by Scottsdale residents. This referendum would have allowed voters to decide on whether housing and ancillary uses should be included in Axon’s development project.
